Terms of service

SAAVVY — TERMS OF SERVICE

Effective Date: 20 September 2026

Welcome to SAAVVY. The terms “we”, “us”, “our” and “SAAVVY” refer to SAAVVY.

SAAVVY operates this website and online store, including all related information, content, features, tools, products and services, to provide customers with a curated online shopping experience (collectively, the “Services”).

SAAVVY's online store is powered by Shopify, which provides the technology and infrastructure that enables us to operate our online store.

These Terms of Service (“Terms”) govern your access to and use of the Services and your purchase of products from SAAVVY.

Please read these Terms carefully before using our website or placing an order. By accessing, browsing or using our Services, or placing an order through our website, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms or our Privacy Policy, please do not use the Services.

Nothing in these Terms is intended to exclude, restrict or waive any consumer right that cannot lawfully be excluded, restricted or waived under South African law.

SECTION 1 — ACCESS AND ACCOUNT

You must provide accurate, current and complete information when creating an account, placing an order or otherwise using our Services.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

You must notify us if you believe your account or login information has been compromised.

You may not use the Services for any unlawful purpose or in a manner that violates these Terms or applicable South African law.

Where a minor accesses the Services, the relevant parent or legal guardian is responsible for supervising that minor's use of the Services and any purchases made through the account, subject to applicable law.

SECTION 2 — OUR PRODUCTS

SAAVVY makes reasonable efforts to ensure that product descriptions, specifications, images, colours and other product information displayed on our website are accurate and up to date.

However, colours and visual appearance may vary depending on your device, display settings and other technical factors.

Product images may be illustrative and may not always represent the exact packaging or minor visual variations of the product supplied.

We may update product descriptions, specifications, availability and other information from time to time.

Nothing in this section limits any consumer right under the Consumer Protection Act 68 of 2008 (“CPA”) regarding goods that are defective, unsafe, unsuitable for their intended purpose or materially different from their description.

SAAVVY may discontinue products or limit quantities where reasonably necessary, subject to applicable law and any rights arising from an order already accepted.

SECTION 3 — ORDERS AND ACCEPTANCE

When you place an order through our website, you are submitting an order to purchase the products displayed in your cart at the price shown at checkout.

An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been finally accepted if the transaction is subject to verification, payment confirmation, stock availability or another legitimate reason.

SAAVVY may decline or cancel an order in circumstances permitted by law, including where:

a product is unavailable;

there is an obvious pricing or product-description error;

payment cannot be successfully processed or verified;

we reasonably suspect fraudulent or unauthorised activity; or

fulfilment is not reasonably possible.

Where we cancel an order after payment has been received, we will refund amounts that are legally refundable to you in accordance with applicable law.

You should review your order carefully before completing checkout.

Nothing in this section limits any statutory cancellation, cooling-off, return or refund right available to you under applicable law.

SECTION 4 — PRICES, PAYMENTS AND BILLING

All prices displayed on the website are stated in South African Rand unless expressly indicated otherwise.

For applicable internationally fulfilled products, standard shipping is included in the displayed selling price. SAAVVY also covers import duties, import taxes and customs-clearance charges for your order.

We arrange international shipping on a Delivered Duty Paid (DDP) basis.

Any optional delivery upgrades and their prices will be shown before the order is completed, where available.

SAAVVY may correct genuine pricing, description or technical errors. Where an error materially affects an order already placed, SAAVVY will communicate with the customer and deal with the order in accordance with applicable law.

Payments may be processed by third-party payment providers. SAAVVY does not ordinarily receive or store complete card details where those details are handled by the payment provider.

SECTION 5 — SHIPPING AND DELIVERY

SAAVVY may use international suppliers, fulfilment partners and courier providers to fulfil orders.

Estimated delivery depends on the product and fulfilment route:

EPROLO in-stock products are typically dispatched within one business day. Allow approximately 7–14 days for delivery.

OriginDrop processing varies by product. Once dispatched from Korea, allow approximately 7–14 days in transit.

These are estimates, not guaranteed arrival dates. Customs processing, courier delays, public holidays, inaccurate delivery information and circumstances outside SAAVVY’s reasonable control may affect delivery.

Tracking information will be provided when it becomes available. Tracking may take time to show its first update after dispatch.

SAAVVY covers import duties, import taxes and customs-clearance charges for your order. We arrange international shipping on a Delivered Duty Paid (DDP) basis. If a courier or customs authority sends you an invoice for these charges, please email it to accounts@saavvy.store with your order number so we can assist. If you have already paid, send the invoice and proof of payment, and SAAVVY will reimburse you for those import-related charges.

Nothing in this section limits any statutory delivery right or remedy available under South African law. Further details appear in our Shipping Policy.

SECTION 6 — RETURNS, REFUNDS AND CONSUMER RIGHTS

Your statutory consumer rights are governed by applicable South African law, including the CPA and the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”).

Qualifying electronic transactions may be subject to the seven-day cooling-off right provided by section 44 of the ECT Act.

Certain transactions and goods are excluded from that cooling-off right by law.

Where the CPA's direct-marketing cooling-off provisions apply instead, the applicable five-business-day period and requirements under the CPA will apply.

Consumers may also have statutory rights relating to defective, unsafe, unsuitable or non-conforming goods.

In particular, qualifying goods may be returned within six months of delivery in accordance with section 56 of the CPA, subject to the requirements and circumstances contemplated by the Act.

Depending on the circumstances, the consumer may be entitled to a repair, replacement or refund.

Please refer to our Refund & Returns Policy for the full return procedure.

Nothing in our Refund & Returns Policy or these Terms limits any statutory right that cannot lawfully be limited.

SECTION 7 — THIRD-PARTY SUPPLIERS AND DROPSHIPPING

SAAVVY may source or fulfil products through third-party suppliers, manufacturers, distributors and fulfilment partners.

A product may therefore be shipped directly from a supplier or fulfilment facility rather than from a SAAVVY-operated warehouse.

The involvement of a third-party supplier does not remove SAAVVY's responsibilities to consumers.

Where a product supplied to you is defective, unsafe, incorrect or otherwise fails to meet applicable statutory requirements, SAAVVY will assist you in accordance with applicable law.

SAAVVY may seek recovery or reimbursement from its suppliers separately. Your consumer rights are not conditional upon SAAVVY first recovering money from a supplier.

SECTION 8 — INTELLECTUAL PROPERTY

Unless otherwise indicated, the SAAVVY name, logo, branding, website design, original text, graphics and other original content created for SAAVVY are owned by or licensed to SAAVVY and are protected by applicable intellectual-property laws.

You may use the website for personal and lawful shopping purposes.

You may not reproduce, copy, modify, distribute, sell, republish or commercially exploit SAAVVY's proprietary content without prior written permission, except where permitted by law.

Third-party trademarks, product names, logos and images remain the property of their respective owners.

SECTION 9 — THIRD-PARTY TOOLS

Our Services may include access to tools, applications, payment services, tracking services or other functionality provided by third parties.

These third-party services may be subject to their own terms and privacy policies.

SAAVVY is not responsible for the independent operation or policies of third-party services to the extent permitted by law.

Nothing in this section limits any statutory consumer right or remedy.

SECTION 10 — THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

These links are provided for convenience and do not necessarily constitute an endorsement by SAAVVY.

We are not responsible for the content, security, privacy practices or operation of third-party websites.

You should review the relevant third party's terms and privacy policy before using its services or providing personal information.

SECTION 11 — SHOPIFY

SAAVVY's online store is powered by Shopify.

Shopify provides the e-commerce platform and technical infrastructure through which SAAVVY operates its online store.

Your purchase of products is a transaction between you and SAAVVY. Shopify is not the seller of SAAVVY products and is not responsible for fulfilling your order or providing consumer remedies in respect of products purchased from SAAVVY.

Nothing in this section limits any right you may have under applicable South African law.

SECTION 12 — PRIVACY AND PERSONAL INFORMATION

Your use of our Services is subject to our Privacy Policy.

SAAVVY processes personal information in accordance with applicable privacy laws, including the Protection of Personal Information Act 4 of 2013 (“POPIA”), where applicable.

Information may be shared with payment processors, delivery providers, fulfilment partners, technology providers and other service providers where reasonably necessary to process and fulfil your order or provide the Services.

Some service providers may operate outside South Africa. Where personal information is transferred across borders, SAAVVY will take reasonable steps to comply with applicable legal requirements.

Please review our Privacy Policy for further information.

SECTION 13 — FEEDBACK AND REVIEWS

If you voluntarily submit reviews, comments, suggestions or other feedback to SAAVVY, you grant SAAVVY a non-exclusive, royalty-free right to use, reproduce, publish and display that content for legitimate business, marketing and promotional purposes, subject to applicable law.

You represent that your submission does not unlawfully infringe the rights of another person.

SAAVVY may remove content that is unlawful, misleading, abusive, defamatory, fraudulent or otherwise inappropriate.

SAAVVY will not knowingly use a customer's review in a manner that falsely suggests an experience or opinion that the customer did not express.

SECTION 14 — ERRORS AND OMISSIONS

There may occasionally be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping information or other website content.

SAAVVY may correct such errors where reasonably necessary.

Where an error materially affects an order that has already been placed, SAAVVY will deal with the situation in accordance with applicable law and will communicate with the affected customer where appropriate.

SECTION 15 — PROHIBITED USE

You may use the Services only for lawful purposes.

You must not:

use the Services to commit or facilitate unlawful activity;

attempt to gain unauthorised access to our systems;

interfere with the security or functionality of the website;

upload malicious code, viruses or harmful software;

impersonate another person or entity;

submit fraudulent or misleading information;

infringe intellectual-property rights;

use automated systems to abuse, overload or interfere with the website; or

otherwise misuse the Services.

We may restrict or terminate access where reasonably necessary to protect SAAVVY, our customers, our systems or third parties.

SECTION 16 — TERMINATION

We may suspend or terminate access to an account or part of the Services where reasonably necessary due to unlawful activity, fraud, abuse, security concerns or a material breach of these Terms.

Termination does not affect rights or obligations that arose before termination.

Nothing in this section affects any statutory consumer right.

SECTION 17 — WARRANTIES AND CONSUMER RIGHTS

To the maximum extent permitted by law, SAAVVY does not warrant that access to the website will always be uninterrupted or error-free.

However, nothing in these Terms excludes or limits:

statutory consumer rights;

rights relating to defective or unsafe goods;

applicable implied warranties;

rights under the CPA;

rights under the ECT Act;

rights under POPIA; or

any other protection that cannot lawfully be excluded.

Where South African law provides a mandatory warranty, remedy or protection, that protection will apply notwithstanding anything else contained in these Terms.

Electronic devices sold by SAAVVY include a one-year warranty against manufacturing defects. This does not cover misuse, accidental damage or normal wear and tear. The warranty applies in addition to statutory rights and remedies and does not replace or restrict them.

SECTION 18 — LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, SAAVVY will not be liable for indirect or consequential losses arising from the use of the website where such liability may lawfully be excluded.

However, SAAVVY does not exclude or limit liability where such exclusion or limitation would be unlawful.

Nothing in these Terms excludes liability for fraud, gross negligence, unlawful conduct or any consumer right or remedy that cannot legally be excluded.

SECTION 19 — INDEMNIFICATION

You agree to be responsible for losses suffered by SAAVVY to the extent that such losses arise directly from your unlawful use of the Services, fraud or material breach of these Terms.

Nothing in this section requires you to indemnify SAAVVY for losses caused by SAAVVY's own unlawful conduct or for liability that cannot lawfully be transferred to you.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective.

SECTION 21 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and other policies referenced on our website, constitute the terms governing your use of the Services and purchases from SAAVVY.

If there is a conflict between these Terms and a mandatory provision of applicable South African law, the law will prevail.

SECTION 22 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or applicable consumer dispute-resolution body.

Nothing in this section prevents a consumer from exercising a statutory right to lodge a complaint with a competent regulatory or dispute-resolution authority.

SECTION 23 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

The updated version will be published on this page with the applicable effective date.

Where applicable law requires notice of a material change, we will provide such notice in an appropriate manner.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
